1.1 If you continue to browse and use this website, including submitting your details through the website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern moov Partners LTD relationship with you in relation to this website. Please note that all calls will be recorded for training, monitoring, or evidential purpose

1.2 If you do not agree to these Terms of Use or our Privacy Policy, you are not permitted to access and use this Website and you should cease such access and/or use immediately.

1.3 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted.

1.4 We may change or alter the content of this website and amend these terms and conditions from time to time by updating this page. As these terms are binding on you please check these terms and note any changes.

1.5 You are responsible for making all arrangements necessary for you to have access to our site.

1.6 We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

1.7 You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and conditions and other applicable terms and conditions and that they comply with them.

1.8 We provide an independent online platform that enables you to research and order regulated property searches and related services from a range of third-party providers. Our service is designed to give you direct access to competitively priced search packs and associated products. 

Non-Refundable Payment and Waiver of 14-Day Cooling-Off Period Upon Payment

Relevant Consumer Law

Consumer Contracts Regulations 2013, Regulation 36(1):

“Where a consumer requests the provision of services to begin during the cancellation period, and acknowledges that, if the service is fully performed, they will lose the right to cancel, the trader may begin work immediately and the consumer’s right to cancel is lost once the service is fully performed.”

Our Policy for Search Orders

In line with this regulation, by making payment for your search order through moov partners, you are expressly requesting us to begin processing your property searches immediately. You understand and agree that by proceeding with payment, you waive your statutory 14-day cooling-off period, and you will lose the right to cancel the contract once we have started processing your searches.

All payments for search orders are non-refundable once your order has been submitted and we have started processing, even if your transaction does not proceed.

2.1(A) Right to Cancel, Immediate Commencement & Refunds

You have a legal right to cancel within 14 days of entering into a contract with us, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

However, when you make payment and submit a search order, you are requesting and authorising moov partners to process your searches immediately. By doing so, you acknowledge and agree that this immediate commencement waives your 14-day cooling-off period, and you will lose the right to cancel or request a refund once we begin processing your order.

If you do not wish to waive your cooling-off period, you must notify us in writing before making payment. In that case, we will not process your search order until the 14-day period has expired.

Once processing of your searches has begun, you cannot cancel and are not entitled to any refund for the searches ordered, even if your property transaction does not proceed.

If the search order is fully completed within the 14-day period, your right to cancel is lost and no refund is available.

2.1(B) Scope of Service Upon Instruction

Upon receipt of payment, which confirms your instruction, moov partners will:

Immediately process and order your property searches from our regulated providers;

Forward confirmation and documentation as required for your transaction;

Liaise with any relevant parties (e.g., your solicitor or agent) to ensure your searches are progressed without delay.

The initiation of this process constitutes commencement of service under the Consumer Contracts Regulations, and your waiver of the cooling-off period applies from the point payment is made and your search order is submitted.

Upon receipt of your instruction and payment, moovPartners will:

Order the requested property searches from our regulated providers;

Send you a confirmation email to inform you that your searches have been ordered.

Once these steps have been completed, which you have expressly authorised by making payment, the service is deemed fully performed. At this point, you have no right to cancel or receive a refund, even if your property transaction does not proceed.

moovPartners offers a Search Fee Guarantee to provide added protection and peace of mind to our clients, the cost for this service is £35 inc VAT.

What is covered:

If your property purchase falls through for any reason after your search pack has been ordered, moovPartners will provide a replacement set of regulated property searches for one subsequent transaction at no additional cost, provided this is requested within six months of the original search order date.

How to claim:

To claim under the Search Fee Guarantee, you must notify moovPartners in writing within six months of your original order, providing evidence of your aborted transaction and details of your new purchase. The guarantee applies only to the same client and is not transferable.

Conditions:

The guarantee covers one set of replacement searches only and must be used within six months of the original order.

The replacement searches will be of equivalent type and value to the original searches ordered.

The Search Fee Guarantee does not cover any administrative or legal fees or other costs associated with your transaction.

This guarantee is only available to clients who have opted in and paid for the Search Fee Guarantee at the time of their original order.

Exclusions:

The guarantee does not apply where the replacement transaction is for a different client, a different legal entity, or a different property type.

moovPartners has a ZERO tolerance policy towards any discrimination, prejudice, or abuse directed at our staff  If, following an investigation, you are found to have engaged in such behaviour, moovPartners reserves the right to terminate your instruction without prior written notice. Where our service has already been provided, no refund will be due. At our discretion, any work completed up to the point of termination may be forwarded to you or your nominated representative within 5 working days.

In the event moovPartners is required to return funds to you due to an overpayment, an administration fee of £25 will be charged to cover the cost of processing and returning the payment. If your original payment was made by debit or credit card, please note that card processing fees (currently 1.75% of the overpaid amount) are non-refundable and will also be deducted from your refund.

Refunds will only be processed if the total amount to be refunded exceeds £25 plus 1.75% of the overpaid amount. If the refund amount is equal to or less than this threshold, no refund will be issued. These charges reflect the administrative and transaction costs incurred by moovPartners. By using our services, you accept that these fees apply if a refund is necessary.

1. Regulated Local Authority Search

What it covers:

Local Land Charges (e.g., planning consents, tree preservation orders, financial charges, enforcement notices)

Planning history, building regulations, pending/planned applications

Road and highway status, adoption, and rights of way

Proposals for new or altered roads, railways, and public schemes

Notices relating to building, environment, health & safety, housing, highways, public health, or flood risk

Conservation area status, compulsory purchase orders, contaminated land, radon, and assets of community value

How it’s produced:

Compiled by regulated agents using official council and government records; fully compliant with Search Code and overseen by the Property Codes Compliance Board (PCCB)

Accepted by:

All UK mortgage lenders (equivalent to official LA search)

Insurance:

£2,000,000 indemnity cover per search, protecting against errors or omissions

Regulatory:

Search Code, IPSA (Independent Personal Search Agents), CoPSO (Council of Property Search Organisations)

Escalations and complaints can be made to The Property Ombudsman (TPO)

2. Regulated Drainage & Water Search

What it covers:

Confirmation of connections to mains water and public sewers (foul and surface water)

Sewer and water main locations (maps included)

Presence of pumping stations or other apparatus nearby

Risk of internal flooding from public sewers

Water supplier details, water hardness, pressure/flow

Status of adoption agreements, and relevant charging basis

Insurance:

Insured up to £2,000,000 for adverse entries that would have been shown in the official CON29DW from the utility company

Regulatory:

Provided by regulated, Search Code–accredited agents. Also under the oversight of The Property Ombudsman and PCCB

3. Environmental Search (EnviroEssential)

What it covers:

Contaminated land (including official designations, past industrial uses, and proximity to hazardous sites)

Flood risk (river/sea, surface water, groundwater, historical events, flood storage, dam break)

Radon risk (based on British Geological Survey data)

Air quality and proximity to Air Quality Management Areas (AQMAs)

Coal mining and brine subsidence risk

Pass/fail professional opinion for lender and client assurance

Insurance:

Remediation warranty (typically £100,000 for 6 years) for contaminated land, plus search provider indemnity

Regulatory:

Provided by Search Code–accredited agents, complaint resolution via The Property Ombudsman, with PCCB oversight

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.

Third-Party Data and Website Content

moovPartners does not monitor, verify, or endorse any data, material, or information submitted or provided by third parties, including search providers, that appears on our platform. Information and quotations collected from third-party product and service providers may be inaccurate, incomplete, or out of date, and we are not responsible for any such content.

Accuracy of Information

While we make reasonable efforts to ensure the information on our website is accurate and to correct any errors or omissions as soon as possible after we are notified, we cannot guarantee that all data, material, and information will be free from errors or omissions.

Viruses and Security

We do not warrant that our website is free from viruses or other harmful components that may affect your technology.

Limitation of Liability

We are not responsible or liable for any direct or indirect losses or damages suffered or incurred by you, or for any losses or damages that were not foreseeable when you accessed or used the website.

We are not responsible for any losses or damages arising from inability to access the website, from use of the website, or from reliance on data transmitted through the website, where such losses or damages are caused by factors beyond our reasonable control, including the nature of electronic data transmission over the internet.

User and Third-Party Reviews

Our website and certain channels may provide access to third-party websites that host product or service reviews. Views expressed in user reviews do not represent the views of moovPartners, and we are not responsible for the accuracy or content of such reviews.

Business Users

If you are a business user, we are not liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage.

We will not be liable to any user for any loss or damage arising from use of, or inability to use, our site; use of or reliance on any content displayed on our site; or use of the services or goods of any advertiser or provider on our site.

Indemnity

You agree to defend, indemnify, and hold harmless moovPartners, its officers, directors, employees, affiliates, and agents from and against any claims, actions, or demands (including reasonable legal and accounting fees) arising from your use of the website or any breach of these terms. moovPartners will promptly notify you of any such claim and may assist in your defence at your expense.

Each of you and us submits to the exclusive jurisdiction of the courts of England and Wales in connection with these Terms of Use and your access to and use of this Website (including any claims or disputes).
